This is a concord between PCN Alert LTD., a British corporation (“PCN Alert"), the owner and operator of www.pcnalert.co.uk (the “PCN Alert Site”), the PCN Alert software, including all content provided by PCN Alert software and the PCN Alert Site, the "PCN Alert Service", or the "Service"), and you (“you” or “You”), a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE, AND PCN ALERT PRIVACY POLICY, WHICH CAN BE FOUND AT http://www. www.pcnalert.co.uk/terms.htm, AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. You remain responsible for observing all the golden rules and laws of safe driving. PCN Alert Limited will not in any event be liable for any fine, penalty, punishment or any notice of intended prosecution issued to anyone who uses the PCN Alert Service.

These Terms of Service apply to all users of the PCN Alert Service. Information provided by our users through the PCN Alert Service may contain links to third party websites that are not owned or controlled by PCN Alert. PCN Alert has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, PCN Alert will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that PCN Alert shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.

Subject to your compliance with these Terms of Service, PCN Alert hereby grants you permission to use the Service, provided that: 1) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms of Service; 2) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without PCN Alert's prior written authorization; 3) you will not attempt to reverse engineer, alter or modify any part of the Service; and 4) you will otherwise comply with the terms and conditions of these Terms of Service and Privacy Policy. In order to access and use the features of the Service, you acknowledge and agree that you will have to provide PCN Alert with your mobile phone, your V5 registration no, your vehicle registration no. You expressly acknowledge and agree that in order to provide the Service, PCN Alert will ask for you your registrations details from DVLA. When providing your mobile phone, your V5 registration no, your vehicle registration no number, you must provide accurate and complete information. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

PCN Alert respects intellectual property rights and expects you to do the same. PCN Alert owns all the intellectual property rights in the Service. Please do not try to copy, distribute use or re-use any material from our Service unless we give you our written permission.

We are not responsible for any loss or damage that You may suffer as a result of You not using PCN Alert correctly or if you fail to comply with these terms. We do not accept any liability for Penalty Charge Notices being issued, or other parking enforcement actions being implemented. You acknowledge that our Services from time to time may be adversely affected by the proximity of buildings, trees, underpasses, local environmental conditions, incomplete or incorrect data and other causes beyond our control. We will not be liable for any loss or damage incurred through failure of the Service to operate or ineffective or incorrect operation. We do not warrant that our Services will continue to be legal to own or use in the UK or in any other country. We will not be liable to you or any user should any changes occur to legislation which might prevent the use of our Services. We will not be liable to you if the performance of our obligations under these terms is prevented or hindered due to any circumstances outside of our reasonable control. You specifically acknowledge that PCN Alert shall not be liable for user submissions or defamatory, offensive, or illegal conduct of any third party that the risk of harm or damage from the foregoing rests entirely with you.

We place great importance on the security of all personally identifiable information associated with our users. Whilst we cannot ensure or guarantee that loss, misuse or alteration of information will never occur, we use all reasonable efforts to prevent it. You should bear in mind that submission of information over the internet and mobile networks is never entirely secure. Using unsecured wifi or other unprotected networks to submit messages through the PCN Alert, is never recommended. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If PCN Alert learns about of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Whilst all reasonable steps have been taken to ensure that this website is free from computer viruses, PCN Alert Ltd accepts no liability in respect of any loss, cost, damage, inconvenience or expense suffered as a result of accessing this website or any of its attachments. Please ensure that you take any steps you regard as necessary to protect your computer system from virus attack. Any or all of the data we collect is in order to provide you with the best possible service and experience. We store all personal data securely and in accordance with the principles of the Data Protection Act 1998. Any personal data you supply to us will be retained by us until 6 months after your Account is deleted. Unless we are obliged or permitted by law to do so your data will not be disclosed to third parties. This does not include our affiliates and / or other companies within our group. The only data used by them will be what is required by them to perform the services that we ask them to provide. Any other use is strictly prohibited. Any data that is processed by third parties shall be processed within the terms of this Policy and in accordance with the Data Protection Act 1998. We may provide links to other websites. We have no control over these other websites and are in no way responsible for their content. In the (hopefully) unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

You may, of course, decline to submit Personally Identifiable Information through the PCN Alert Site, in which case PCN Alert may not be able to provide certain services to you. You can stop using our Services at any time, although we’ll be sorry to see you go. If you do not agree with our Privacy Policy or Terms of Service, please delete your account and discontinue use of the PCN Alert Service; your continued usage of the PCN Alert Service will signify your assent to and acceptance of our Privacy Policy and Terms of Service.
